These Terms of Use ("Terms") govern your use of Biblify AI ("Service") operated by Eunoia Apps LLC ("Company," "we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Service.

1. Use of the Service

Biblify AI is provided for informational and personal productivity purposes only. You agree to use the Service in accordance with all applicable local, state, and federal laws and regulations.

2. Intellectual Property

All content and materials on the Service, including but not limited to text, graphics, logos, and software, are the property of Eunoia Apps LLC or its licensors and are protected by copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit any part of the Service without our prior written consent.

3. User Conduct

You agree not to:

• I. Use the Service for any unlawful purpose or to solicit others to perform or participate in unlawful acts;
• II. Interfere with or disrupt the operation of the Service;
• III. Attempt to gain unauthorized access to any portion of the Service or any systems or networks connected to the Service;
• IV. Use the Service to transmit any harmful or malicious code.

4. Disclaimers

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied. Eunoia Apps LLC does not warrant that the Service will be uninterrupted, secure, or error-free.

5. Limitation of Liability

To the fullest extent permitted by law, Eunoia Apps LLC shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of or inability to use the Service.

6. Governing Law

These Terms are governed by the laws of the State of New Jersey, without regard to its conflict of law principles. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in New Jersey. This provision regarding legal venues does not apply to consumers residing in the European Union. If you are an EU-based consumer, you may initiate legal proceedings in the courts of your country of residence.

7. Third-Party Services and AI Processing

As part of the functionality of Biblify AI, user input submitted through the Service is processed by third-party service providers—OpenAI. By using the Service, you acknowledge and agree that your input may be transmitted to such third-party providers for the sole purpose of generating AI responses. Eunoia Apps LLC does not store, monitor, or retain user input or AI-generated content, and disclaims all liability related to data handling by third-party providers. Your use of the Service constitutes your agreement to any applicable terms and privacy policies of such third-party providers.

8. Payment & Subscription Terms

Biblify AI is offered on a subscription basis through the Apple App Store. By subscribing, you agree to Apple's payment and billing terms.

Subscription Options:

We offer weekly, monthly, and yearly subscription plans. Payment will be charged to your Apple ID account at the time of purchase or at the end of any applicable free trial period.

Free Trial:

New users may be eligible for a one-time 3-day free trial. At the end of the trial, unless canceled at least 24 hours before it ends, your selected subscription plan will automatically begin and you will be charged accordingly.

Limited-Time Discount:

We may offer a one-time, limited-time discounted rate for the yearly plan. This offer is only available once per Apple ID and cannot be reactivated, even after reinstalling the app.

Auto-Renewal and Cancellation:

Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the current period ends. You may manage or cancel your subscription through your Apple account settings. Upon cancellation, you will continue to have access to the Service for the remainder of your billing cycle.

Refund Policy:

Refunds are handled solely by Apple and are granted at their discretion. Refunds will only be considered in cases involving technical issues or service failures. We do not offer refunds for unused subscription periods.

9. Changes to These Terms

Our Terms are subject to change without prior notice. Any changes will be posted on this page with a "Last Updated" Date. Continued use of our Service after modifications constitutes acceptance of the revised policy.
